This is a courtesy translation. In case of any discrepancy, the Polish version of this document prevails. These Terms set out the rules for using bedcal.com and the conditions for concluding and terminating contracts for the provision of services by electronic means.

1. Service provider
The service provider is Event Space sp. z o.o., ul. Kanarkowa 47, 11-041 Olsztyn, Polska, entered in the register of entrepreneurs of the National Court Register kept by the District Court in Olsztyn, 8th Commercial Division, under KRS number 0001210621, tax ID (NIP) 7394025935, statistical number (REGON) 543470060, share capital 5 000,00 zł, fully paid up.

2. Scope of the service
The service provides subscription software for managing an accommodation property: booking chart, room allocation, check-in, meal planning, payment records, tasks and statistics.
The software runs in a web browser. A device with internet access and an up-to-date browser is required.
The provider does not act as an intermediary in the sale of accommodation and charges no commission on bookings entered by the customer.
3. Conclusion of the contract and trial period
The contract is concluded when an account is created in the service.
Every new account includes a free trial period counted from the first booking entered. The trial requires no payment card details.
After the trial ends, the account switches to read-only mode until a subscription is purchased. Data entered by the customer is not deleted.
4. Subscription and payments
The subscription price depends solely on the number of beds in the property. Every plan includes the full range of features.
The subscription may be purchased for one month or one year. With annual purchase the fee corresponds to ten months.
Prices shown in the service are net; value added tax is added at the rate in force on the invoice date.
Payments are handled by an external payment provider. An invoice is issued once the payment is credited and sent to the address given in the account settings.
The subscription does not renew automatically. The customer decides on renewal before the validity period ends.
5. Withdrawal and refunds
A customer who is a consumer, and a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for them, has the right to withdraw from the contract within 14 days of its conclusion, without giving a reason.
A withdrawal notice should be sent to info@bedcal.com. The fee is refunded within 14 days of receiving the notice, using the same payment method.
If an annual subscription is cancelled after the withdrawal period, the provider refunds the fee for unused full months, reduced by the difference between the annual price and the monthly price for the period actually used.
6. Customer obligations
The customer undertakes to use the service in accordance with the law and these Terms, and in particular not to enter unlawful content.
The customer is responsible for the accuracy of the data entered into the service and for keeping account credentials confidential.
The customer undertakes not to take actions that disrupt the service, including attempts to gain unauthorised access to other users' data.
7. Availability and maintenance
The provider makes every effort to keep the service running continuously and declares a target availability of 99% per month, excluding scheduled maintenance.
Scheduled maintenance lasting longer than 30 minutes is announced at least 24 hours in advance.
The provider is not liable for unavailability resulting from causes beyond its control, in particular a connection failure on the customer's side or force majeure.
8. Liability
The provider is liable for damage caused to a customer who is not a consumer only within the limits of actual loss incurred, up to the amount of fees paid in the 12 months preceding the event.
This limitation does not apply to damage caused intentionally, nor to cases where liability cannot be excluded under mandatory provisions of law.
The provisions of this section do not limit consumer rights arising from the law.
9. Termination
The customer may cancel the service at any time by deleting the account in the service settings.
The account is deleted 7 days after the request; the request can be withdrawn during that time. After that period the data is permanently deleted.
The provider may terminate the contract with 30 days' notice, refunding the fee for the unused subscription period.
10. Complaints
Complaints should be sent to info@bedcal.com, quoting the licence number and a description of the problem.
The provider examines a complaint within 14 days of receipt and reports the outcome to the address the complaint was sent from.
A consumer may use out-of-court complaint resolution, including the online dispute resolution platform available at ec.europa.eu/consumers/odr.
11. Changes to the Terms
The provider may amend these Terms for important reasons, in particular a change in law or in the scope of services provided.
The customer will be informed of any change at least 14 days before it takes effect. No objection within that period means acceptance.
If the customer does not accept the change, they may terminate the contract with immediate effect and receive a refund for the unused period.
12. Final provisions
Matters not covered here are governed by Polish law, in particular the Civil Code and the Act on Providing Services by Electronic Means.
Disputes with a customer who is not a consumer are settled by the court having jurisdiction over the provider's registered office.
